Disbursement

A payment made by a solicitor or executor to a third party on behalf of an estate.

Estate

The total value of everything you own when you die, minus any outstanding debts and liabilities.

Executor

A person or people named in a Will to carry out your wishes and manage your estate.

Grant of Probate

The official legal document that confirms an executor has authority to administer an estate in England and Wales.

Guardian / Legal Guardian

A person appointed in a Will to look after children under 18 if you die.

Inflation-proof Gift

A gift intended to retain its value over time. Leaving a percentage of your estate may keep pace with inflation more effectively than leaving a fixed cash sum.

Inheritance Tax (IHT)

A tax that may be payable if an estate is above the government’s tax-free threshold. Gifts to registered charities are generally exempt from Inheritance Tax and may reduce the tax due.

Intestate

The legal term for dying without a valid Will. When this happens, the law determines how your estate is distributed.

Legacy / Bequest

A gift left to a person or charity in a Will.

Legator

A person who makes a Will and leaves a legacy.

Letters of Administration

A legal document issued by the Probate Registry appointing someone to administer an estate when there is no valid Will or no executor able and willing to act.

Liabilities

Debts and other amounts, such as loans, bills, or taxes, that must be paid from an estate.

Life Interest

A gift that allows someone to use an asset, such as living in a property or receiving income, during their lifetime. The asset then passes to another beneficiary.

Living Will / Advance Decision

A separate document from an estate Will that records your wishes about refusing specific medical treatments if you later cannot communicate your decisions.

Mirror Will

One of two Wills made by partners that are broadly similar and usually leave assets to the surviving partner first, followed by chosen beneficiaries or charities.

Moveable Property

Personal possessions or assets that are not land or buildings.

Pecuniary Gift / Legacy

A fixed sum of money left to a person or charity in a Will.

Personal Representative

The person responsible for administering an estate, whether they are an executor named in a Will or an administrator appointed by the court.

Potentially Exempt Transfer (PET)

A lifetime gift that may become exempt from Inheritance Tax if the person making it lives for at least seven years afterwards.

Predeceased

A person named in a Will who dies before the person who made the Will.

Probate

The legal and financial process of administering an estate, including confirming the Will, dealing with assets, paying debts, and distributing gifts.

Residuary Beneficiary

A person, organisation, or charity entitled to receive all or part of what remains of an estate.

Residuary Gift / Legacy

A gift made from what remains of an estate after debts, taxes, costs, and other gifts have been paid.

Residue

What remains of an estate after specific gifts, debts, funeral costs, and taxes have been paid.

Reversionary Interest

An interest in an asset or property that passes to another named beneficiary after a specified event, such as someone’s death.

Simple Will

A basic Will for straightforward wishes, usually where there are no complex assets or tax considerations.

Single Will

A Will made for one person, whether they are single, married, or in a partnership.

Specific Gift / Legacy

A particular item or asset left to someone in a Will, such as jewellery, a car, artwork, or shares.

Testator / Testatrix

The legal term for a man or woman who has made and signed a Will.

Trust

A legal arrangement in which assets are managed by trusted people for the benefit of someone else.

Trustee
